Musharraf’s non-appearance in court affecting Pak army’s reputation : Aitzaz

mushrafISLAMABAD: Leader of the Opposition in Senate and the leader of Pakistan People’s Party (PPP) Barrister Aitzaz Ahsan has said that non-appearance of the former president general (retd) Pervez Musharraf in the court is affecting the good reputation of the Pakistan army, saying that it is understandable as to why the former army chief is frightened while appearing in the court.

While talking to media in the Supreme Court on Wednesday, Leader of the Opposition in the Senate and the leader of Pakistan People’s Party (PPP) Senator Barrister Aitzaz Ahsan said that Pervez Musharraf would have to appear in the court at all costs. Barrister Aitzaz Ahsan gave examples of the different countries, saying that the democracy strengthened after the trials of army generals in those countries.

However, Leader of the Opposition in the Senate and the leader of Pakistan People’s Party (PPP) Barrister Aitzaz Ahsan said that the opposition would support the government of Pakistan Muslim league-Nawaz (PML-N) if any interference was made in the democratic system by the army.

He said that army chief has no authority to get started the court martial against the former general Pervez Musharraf, saying that the gazette notification is clear evidence against the former dictator and there is no need to prove it.

Aitzaz Ahsan said that president has the authority to forgive sentence given to anybody. He expressed his expectation that former president general (retd) Pervez Musharraf would appear in the special court today (Thursday) for the proceeding under article 6 of the constitution, saying that Musharraf is a valiant person and he is not terrified while facing hardships.

He said that there has already been much interference of army in the democracy and would no longer be there, saying that Pak army has nothing to do with the case against the former army general.

Aitzaz Ahsan said that the court is not going to shoot Pervez Musharraf, saying that it is a matter; ‘jo dar gia wo mar gia.

He said that former president Asif Ali Zardari is appearing in the court and Pervez Musharraf would have to appear in the court as well.

To a question, he said that former prime minister is not appearing in the courts because he took steps as a prime minister and therefore, it is the stance of the former prime minister that he has immunity under article 248 of the constitution while Pervez Musharraf issued all orders including suspending judges of the judiciary, imposition of emergency in his personal capacity, saying that because he said that “I, the general Pervez Musharraf abrogate the constitution and judges.”

Aitzaz Ahsan said that his (Mushrraf’s) saying ‘I’ is causing problem for him (Musharraf). To a question, he said that Pervez Musharraf should be given full right of transparent trial and the report given by the medical board regarding his health has much importance and the court would definitely consider the medical report.

To another question, Aitzaz Ahsan said that patient has no discretion to go abroad for medical check-up and if such practice is adopted then hundreds of prisoners in jails in the country, who have been given death sentences, may apply for going abroad on medical grounds and go aboard.

Aitzaz Ahsan said that medical report of Pervez Musharraf shows that he is not suffering any ailment which may cause any hindrance in his way while appearing in the court.
