The court expressed its displeasure over the IG FC Major General Ijaz Shahid’s failure to appear before the court despite being summoned

Meanwhile, Chief Justice Iftikhar Muhammad Chaudhry has remarked that the court has proofs that missing persons are in army custody; court wants that missing persons should be presented before the court at any cost.

The four-member of apex court headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justices Jawwad S Khawaja, Khilji Arif Hussain and Amir Hani Muslim heard the Balochsitan law and order case at SC Registry in Karachi.

During proceedings, Chief Justice Chaudhry asked the Deputy Attorney General who the contempt of court notice should be issued to after the IG FC had failed to appear.

The Deputy Attorney General informed the court that they had tried to send the court’s order to the IG FC but there wasn’t enough time.
Justice Khilji Arif Hussian inquired why accused FC officials along with Brigadier Aurangzeb, Subedar Momin, Major Tahir and Colonel Naeem were not presented before the court.

The Deputy Attorney General replied that it was the FC’s stance that these officials had returned to the Army. Chief Justice Chaudhry remarked that if they were part of the army, the headquarters should be told to present them.

The court has ordered the FC officials to appear before DIG CID on Sunday.

Despite the Supreme Court’s strict orders, neither the Inspector General Frontier Constabulary (FC) Balochistan turned up before the apex court, nor was any of the ‘missing persons’ was produced in apex court.

The IG FC was ordered by the SC to appear before the bench with all the 35 undeclared detainees.

Counsel of the FC told the court that the court ordered could not be delivered to the FC chief and other officers owing to the shortage of time.

“What actually you people want?” the Chief Justice addressed the FC representative. “Tell us to whom should we issue the contempt of court notice,” the CJ asked.

The court later issued orders for 19 FC officials booked in an FIR to appear before DIG CID Balochistan.

Responding to the court FC lawyer argued that all the officials were no more in FC but have rejoined army. To which, the bench ordered that they be called through army’s Station Commander.

Meanwhile, the court ordered IG Sindh Shahid Nadeem Baloch to provide security to the fam members of missing persons who have set up a protest camp outside the Karachi Press Club.
