A three-member bench of apex court comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Jawad S Khawaja and Justice Sheikh Azmat Saeed heard the case.
The court ordered Inspector General Khyber Pakhtoonkhwa (KPK) police Ahsan Illahi to recover the citizen Khair-ur-Rehman till tomorrow (Aug, 06) and present him before the court. Court has directed IGP KPK to appear before the court if he fails to produce abductee before the court and court would issue appropriate orders.
During the course of hearing the IG said that the investigation officer has been removed but the court observed that it’s a simple case because the sister of Khair-ur-Rehman, namely Khaista Khan has identified the police inspector Arshad stating that this person has kidnapped her brother and she is eye witness.
Why police has not arrested and recovered the missing person yet CJP remarked adding that police has not made any progress in the case so far.
Justice Jawwad remarked that court can not remain silent if the executive does not perform its duty. Court in its order maintained that although police functionaries have not implemented the court orders court gives another chance for recovery of the missing person Khair-ur-Rehman.
Meanwhile the court heard another missing person Ghulam Sajjad Amjad’s case. During the hearing IGP Punjab police Khan Baig appeared before the court. The police official informed the court that missing person Ghulam Sajjad is not present in Qasim Bela area near Multan. He said that police has written letter to the secret agencies but hey have not replied so far that Ghullam Sajjad is present in the interment centers or not.
Meanwhile the Additional Attorney General Tariq khokhar informed the court that federal government has constituted task force for recovery of the missing persons. The court observed that task force has did nothing and would not do any thing.
Additional Attorney General said the government would follow the instruction of the apex court upon that court showing annoyance said that why executive is trying to surrender its authority before the court it is the duty of the executive despite of the court. Executive should perform its duty otherwise court would send all the legal heirs, children and other family members to Secretary interior through orders and than he has to provided all necessities of life to them, CJP observed.
Chief Justice Chaudhry maintained that if the directions of the court would be over ruled the court would issue stern orders, adding that the families of missing persns are in miserable conditions
