Special Court reserves verdict regarding FIA report

mushrfThe Special Court constituted to try former president General (retd) Pervez Musharraf for treason has reserved verdict on Musharraf’s counsel application seeking investigation report of FIA.

The three-member bench of the special court headed by Justice Faisal Arab heard the high treason case in Federal Shariat Court on Friday.

During case proceedings, Barrister Farogh Naseem argued that the Official Secrets Act exists in Pakistan, however, FIA’s investigation report does not come under this act.

Justice Faisal Arab remarked that investigation report would not have been broadcasted on the media if it was under the Official Secrets Act.

Farogh Naseem said that the treason case has been filed on that report and it is the right of accuse to cross examine the people who have been given statements before FIA.

He said the this trail could bring important results and the small thing in that report can benefit the accused and we want to know that on which basis this report had been prepared.

Farogh Nasim was of the view that fair trail is the right of accuse if there is not transparency than trail should not be conducted. The prosecution has admitted that there is no record present in PM secretariat regarding the November 03 action, Farogh said.

Justice Faisal Arab said that more time would be needed to decide the application. Upon that Farogh Naseem sought one week time but the court reserved its decision on the plea and adjourned the case hearing till April 28.
On March 31, Musharraf was formally charged with subverting and circumventing the constitution by imposing emergency on November 3, 2007. Musharraf had rejected the charges levelled against him.
