During proceedings of the case, two witnesses appeared on behalf of the prosecution. Cabinet Division Section Officer, Kaleem Ahmed Shehzad and ex- Deputy Secretary Siraj Ahmed recorded their statements in court and was cross-examined by Musharraf’s lawyers.
Both witnesses presented the original documents pertaining to the 2007 emergency and PCO.
Kaleem Ahmed Shehzad and Siraj Ahmed presented the original documents before the Special Court documents pertaining to the 2007 emergency and PCO during the hearing.
They also recorded their statement, in which they said that an officer Khalid Rasool Deputy Director of the Federal Investigation Agency (FIA) came to their office on December 4, 09, and 19 respectively last year and asked for the relevant documents including the verified copy of the proclamation of the emergency and the letter sent by President House Secretariat.
They added that these documents were given to the FIA officer by the approval of then Secretary Cabinet who is authorized to order for giving the copies.
Ex Deputy Secretary also provided thee envelops of letters regarding emergency, PCO, etc sent by the presidency and received by the Secretary Cabinet.
Both witnesses were of the view that the proclamation of emergency order, PCO and other documents were signed by the than Chief of Army Staff Pervaiz Musharraf and documents have been provided to the FIA with the approval of Secretary Cabinet. They submitted the written approval of Secretary and Court exhibited the approval of secretary.
During the cross examine both witnesses were of the view that accused Musharaf has not signed on the documents in their presence and these documents were handed over to the FIA in the office of Section officer Kaleem Ahmed.
On the question of Musharraf’s lawyer Shaukat Hayat Siraj Ahmed said that if cabinet secretary receives sensitive documents or record it did not mentioned in the routine register and for doing so there are separate rules.
After completion of the both witnesses the court adjourned the hearing of case till July 08 and summoned other prosecution witnesses to record their statement.
It is worth mentioning here that Musharraf is facing treason charges for subverting and circumventing the Constitution by imposing emergency on November 3, 2007. The federal government had also placed his name on the ECL, stating he might try to abscond.
